Cape Henry Beach Replenishment Update - Date: March 16, 2010

As of the close of business on Monday, March 15, 2010 the contractor had completed hauling sand to the eastern portion of Cape Henry Beach.  The project included hauling 50,000 cubic yards of sand and reached from Ships Watch Court, where replenishment from the navigation project terminated, to the border with First Landing State Park/Kendall Street received sand from this effort[.]

Restoration of the Oak Street beach dune-access is anticipated to be completed by this Wednesday March 17, 2010 (with sprigging of the beach dune-access (sides of dunes) to be performed in the coming weeks).  Oak Street is also scheduled to receive street sweeping this Wednesday.  Public Works Operations has observed no damage to Oak Street and will re-review Oak Street upon completion of the street sweeping.  Public Works - Operations is scheduled to rake Cape Henry Beach this week as final completion of the beach replenishment.

A topographic survey of the beach has been scheduled to commence next week to document the ‘after placement’ condition.

3rd weekly update on Cape Henry Beach Replenishment

***UPDATE ****  As of 3-5-2010, The contractor was not able to work on Wednesday 3/3/10 (due to the Nor’easter) and the remaining sand material removal from the Maple Street Dredge disposal area is taking longer to remove than we first anticipated.  We anticipate completion of the truck haul early next week and then another week to re-establish the Oak Street vehicular beach access

The following is the third weekly update for the Cape Henry Beach truck haul replenishment contract as provided by Phill Roehrs, Water Resources Engineer with Public Works Engineering:

“As of the close of business on Monday, March 1, the contractor had hauled 36,000 cubic yards of sand to the eastern portion of Cape Henry Beach.  The entire reach from Ships Watch Court, where replenishment from the navigation project terminated, to the border with First Landing State Park/Kendall Street has received sand from this effort.

Approximately 4,000 cubic yards of material remained available at Monday’s close for hauling to the beach – our revised estimate for total quantity is 40,000 cubic yards.  The remaining material will be spread to the east of Oak Street.  The sand quality continues to be outstanding.

Hauling did not occur this past Saturday, February 27; the contractor used the time to scour the Maple Street Dredged Material Management Area for all remaining sand, creating a final stockpile and reconfiguring the staging for efficient hauling this week.  We anticipate that the haul will be completed sometime this week.  The restoration of the Oak Street vehicular beach access will commence immediately following the truck haul.  Work hours for the truck haul and the beach access restoration will continue as 7 a.m. to 5 p.m. on weekdays and 7 a.m. to 2 p.m. on Saturday.

No citizen concerns were received this week, and there have been no reported traffic incidents.  No damage to Oak Street has been observed, however a final and detailed inspection will occur after the completion of the beach access restoration and any needed repairs will be promptly scheduled.  A topographic survey of the beach has been scheduled to commence next week to document the ‘after placement’ condition.”

Update on Cape Henry Beach Replenishment

The following is the second weekly update for the Cape Henry Beach truck haul replenishment contract as provided by Phill Roehrs, Water Resources Engineer with Public Works Engineering: 

“As previously reported, hauling began on February 10, 2010.  As of the close of business on Monday, February 22, 22,000 cubic yards of sand had been hauled to the beach and spread between Ships Watch Court and Oak Street.  The contractor is now placing sand east of Oak Street.
We have revised our estimate of the quantity of sand available to be approximately 35,000 cubic yards – the contractor has been able to remove quality sand down to elevation 2 feet, NAVD, within the Maple Street Dredged Material Management Area, almost two feet deeper than we had originally anticipated.  Again, our intention is to remove all available sand from the Maple Street site, we are actively looking for every opportunity to maximize the volume.  We are also closely monitoring the material quality with a full-time inspector at the borrow site, no objectionable loads have left the site. 
We continue to field-adjust the cross section to assure that the fill operation will extend all the way to First Landing State Park with the largest possible beach berm dimension.  The finished beach is a substantial and notable improvement.  The sand placed on the beach is of such a quality that it is difficult to distinguish the new material from the existing beach sand – from color to grain size to shell content.  We have not discovered any pockets of deleterious material, but if found on final inspection we will promptly schedule a visit by Beach Operations to sift and groom any objectionable areas.
Work hours continue as 7 a.m. to 5 p.m. Monday through Friday and 7 a.m. to 2 p.m. on Saturday.
With roughly 13,000 cubic yards to go, we anticipate the hauling will be complete by the end of the first week of March.  We continue to monitor the condition of Oak Street, and will schedule repairs if necessary immediately after hauling and the Oak Street beach access restoration are complete.
No concerns or objections from citizens were received during this week, and there have been no traffic incidents.”

The city went to court last year to condemn property for public recreational use and the replenishment. Beach officials had asked all the Cape Henry Bayfront owners to sign over public easements to the beach in exchange for the sand. The landowners who wanted the sand to protect their homes from storm damage turned over the easements. But those who wanted to maintain their private property rights, which date back to Reconstruction, refused and were eventually defeated in court.

Update on beach replenishment

Beach Sand Replenishment Continues

Hauling began on February 10.  By the close of business on Monday, February 15, the contractor had hauled 7,730 cubic yards to the beach.  This material was spread between Ships Watch Court and the VB Resort & Conference Center, about 1,700 feet, working west to east.  The fill rate is approximately 3.2 cubic yards per foot, yielding a beach berm approximately 70 feet wide at elevation 5 feet, NAVD.

The total volume of sand available at the Maple Street Dredged Material Management Area for the truck haul is approximately 25,000 cubic yards.  This is less than we had hoped, but is a sufficient amount to place the above described beach cross section on the entire beach from Ships Watch Court to First Landing State Park.  We will completely evacuate the Maple Street site, take all available sand.

Given the contractor’s production rate of about 1,720 cubic yards per day, we anticipate that hauling will be complete by the end of February or very early March.

The operation involves 6 ‘quad’ on-road dump trucks cycling between Maple Street and Oak Street (0.75 miles).  The material is dumped on the beach at the Oak Street access, then transferred by an excavator to 2 off-road dump trucks for the beach transit to the placement area.  A bulldozer is stationed at the placement area to shape the fill into a beach berm.  The beach access at Oak Street has been temporarily graded and lined with timber mats, and will be fully restored at the conclusion of the haul.

Work hours at 7 a.m. to 5 p.m. Monday thru Friday and 7 a.m. to 2 p.m. of Saturday.

We have received two ‘concerns’ so far, one by e-mail from the Bailey family wanting to know whether the beach access will be restored.  We responded the same day (Saturday) with an assurance that the access will be restored, and they responded in a positive and appreciative manner.  The second ‘concern’ was voiced in the field to our inspector regarding the potential that the cross beach drains could be blocked by the fill.  Our inspector assured the citizen that the grading operation will provide positive drainage at the outfalls.

We are monitoring the condition of Oak Street for wear and potential damage from the operation.  PW/Operations is standing by to repair or overlay the street at the conclusion of the project as necessary to restore it to ‘as good or better’ condition than prior to the operation.

Cape Henry Beach Replenishment update since Nor’Ida

I am responding on behalf of Public Works at the request of Councilman Jim Wood concerning your questions about the sand replenishment on Cape Henry Beach.  We know that the recent nor’easter has increased the urgency and scope of this project.  We want to assure you that the City is committed to protecting your bayfront communities, and we are working as quickly as possible to replace as much sand as we can.

Please understand that the current replenishment activity on Cape Henry Beach is a by-product of the federal navigation project to maintain Lynnhaven Inlet.  There is a fixed amount of sand available within the Congressionally-authorized template for the Lynnhaven Inlet channel system.

As to the distance to be covered, there is sufficient sand available to extend beyond the Lynnhaven Fishing Pier.  The exact distance is not known, but estimates are that it will extend approximately 2,000 feet east of the pier before the available supply is exhausted.  The City did fund a modification to the contract to reduce the width of beach fill, which increased the anticipated length of the placement.  This action required the use of a booster pump for the dredge, funded by the City.  We are in the process of authorizing this request.
Upon completion of the Corps’ dredging process, the city will assess the Cape Henry Beach replenishment.  Because of the recent nor’easter, the city is looking to haul sand material from the Maple Street dredge disposal site to Cape Henry Beach.  To do this, however, requires certain project modifications that must be approved by the City and the Virginia Marine Resources Commission (VMRC).  The City is in the process of requesting modification of the original Cape Henry Beach Replenishment Permit so as to allow the City to move forward with sand hauling.
The City will be pursuing Council approval in the coming weeks, along with approval of our permit modifications request by the VMRC.  Upon approval from both, the City can begin hauling sand to Cape Henry Beach from Maple St.  Once we begin, the replacement operation should take approximately 45-60 days to complete.

As most of you know, after a 3 day trial, on Friday the city prevailed in preserving the Cape Henry beaches for public use and for the placement of sand from the Lynnhaven Inlet dredging project.

We do anticipate that people dissatisfied with the ruling will come to the VMRC hearing tomorrow to try to block the project.

If you live in the area and want to preserve the beaches for the public’s use and for the placement of sand from the federal dredge project, please consider attending this meeting and making your voice heard.

Cape Henry property owners aren’t asking taxpayers to pay

The editorial board of The Pilot recently wrote that Cape Henry Beach properties in Virginia Beach belong, by deed, to private owners. Yet, amazingly, that same opinion stated that such ownership is a mere technicality regarding private property rights.

  It appears the normally civicminded folks on the board have relied on incomplete information. This is alarming on an issue as important as citizens’ private property rights and a government that uses eminent domain against those rights.

  Our deeds to these Cape Henry beaches, in fact, are unique in the commonwealth, date back to pre-Colonial times and have a documented, historic chain of ownership.

  Our particular property and two other contiguous properties are on a section of the beach that continues to accrete; this part of the beach has   gained 150 feet of beachfront since 1956.

  The owners of these three properties have never requested the city or Army Corps of Engineers to place sand on our beach. We have never requested the city to pick up trash or to provide police patrols for our private beach. We have, in fact, spe   cifically requested several times that the city not trespass on our private property for these publicly funded maintenance efforts. We have not disputed the public’s right to walk along the waterline of the beach, and we have enjoyed harmony and good will among our visitors and guests.

  Our neighboring beach properties to the east need beach erosion protection. Placing the spoils of future Lynnhaven Inlet dredging on those beaches would be cost-effective for the city.

  These facts led our three communities that do not need sand replenishment to offer, at no cost, a renewable construction easement to the city. It would ensure that the Army Corps would have the necessary permissions from private properties to place pipe and equipment on our beaches to deposit sand on   these eastward beaches. This construction easement would facilitate dredging the channel and would provide sand replenishment to those beaches that suffer serious erosion.

  The city, rather than accept our offers to volunteer a renewable construction easement, additionally demanded a “recreational easement” for public use. The city’s attempt to take privately owned property is an infringement on our constitutional rights as private property owners.

  Yes, as you surmise in your editorial, all of us would like to avoid a costly court battle. As homeowners and taxpayers, we couldn’t agree more.

  We would’ve liked to see the city avoid the cost of a private law firm under city contract that has billed $285,475 just from 2003-05 on this specific issue. Additional charges from 2006-09 are $1,066,720.  The City Attorney’s Office states that this represents “a substantial amount of the work done from 2006-2008 related to Cape Henry Beach as well as portions that relate to other beaches as well.”

  Your opinion that taxpayers would be paying for “property owners to benefit from wider beaches in their backyards” is exactly why those of us who are property owners are not requesting such a “benefit.”

  Our specific beach property, for which we have title, is our backyard, is private property, and we are not asking taxpayers to pay for the benefit of a wider beach or for city services.

City condemns parts of Cape Henry beach for sand replinshment

The Army Corps of Engineers plans to dredge the Lynnhaven Inlet this year, and city officials want the sand piped along two miles of shore between First Landing State Park and the Lesner Bridge.

Old Business-
Indigo Dunes Project – Department of Environmental Quality (DEQ) has asked for more time to review and answer the public’s concerns before going before the State Water Control Board (WCB).  The next WCB meeting is scheduled for September 30th.  The SDCC Pleasure House Point (PHP) committee has scheduled a meeting with the Chesapeake Bay Foundation (CBF), Lynnhaven River Now (LRN), Wetlands Watch and our legal representation to put together a plan for the WCB hearing. 

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – City Staff is still pursuing the purchase of land behind the AT&T-Battery Plus building on the Blvd. for the dredging of the Western Branch as a permanent dredge transfer station. This site would also provide kayak
& canoe access when not being used as a transfer station.  City Staff is looking at purchasing or condemnation of all the property in the area (excluding the vets office) to also allow a Fire Station.  Staff plans to present details to City Council on Aug 12 at a closed session.
[Correction 2:18pm Monday July 28th 2008.]

Proposed Rezoning of City Marina - Planning Commission review was deferred from the July 9th meeting to the August 13th meeting at noon in City Council Chambers.  SDCC has sent a letter to City Staff and Council opposing the rezoning from P-1 to B-2.  Reasons for opposition include the fact that a marina is considered a principal use in a P-1 zoning district so there is no need to rezone and the current arrangement is a money making venture for the City, about $50,000 per year.  Making it a private venture runs the risk of losing this income.

City Council Candidate Forum and Questionnaire –  SDCC agreed to partner with OPCL and host a City Council Candidate Forum the week of September 22nd – 26th.  The locations suggested were the VB resort conference hotel, Baylake Pines church, Lynnhaven Congregational church and Westminster Canterbury.  It was recommended that Todd moderate and the format still needed to be decided.

SDCC Oyster Roast – Mark your calendars for Saturday Nov 15th from noon until 4pm at the VB Resort Conference Hotel.  First committee meeting is scheduled for Thursday August 21st at 6:30pm at Charlie’s Restaurant.  Volunteers are needed, email Todd if you’re interested in helping.  Todd@sdcc.info

SDCC Officer Nomination Committee – The nominating committee is narrowing down the list of candidates and is still in need of a good candidate for Vice President or Secretary.  If you are interested in running or know of anyone that may be, please contact Dan Creedon at DanVaB@aol.com.  The committee will make their presentation of names at the October 27th general meeting.

New Business -

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – Should SDCC write a letter to City Staff and Council supporting the plan to purchase and/or condemn businesses behind PEP Boys for a transfer station?  Should SDCC partner with Saw Pen Point C.L. is support of this site?

Community Legislative Town Hall Meeting -The City of Virginia Beach and the Virginia Beach Council of Civic Organizations will be co-hosting a town-hall style discussion to give citizens an opportunity to provide valuable input into the City’s 2008 Legislative Agenda – goals which the City will submit to members of the local General Assembly delegation later in the year.  Meeting will be Wednesday August 6th at 7:30pm in the VB Convention Center and is open to the public.
Indigo Dunes Project – With the possible Sandlers financial troubles reported by the Virginian-Pilot, does the SDCC think it’s a opportune time to sit down with City Staff and Council to discuss working up possible purchase scenarios (land swaps, tax reductions, etc.) and then have the City pursue these plans with the Sandlers?

Program/Presentation – Mr. Lou Paulson, Posieden Court Condominiums, will be discussing viewpoint as to why it’s a bad idea for Cape Henry Beach landowners to sign over a public easement to the City for sand replenishment. The Sand Replenishment project is one that has been discussed for awhile and has a potential project date of late 2009/early 2010. If you are in favor or against, come on out and hear Mr. Paulson’s views.

Old Business-
Indigo Dunes Project – Department of Environmental Quality (DEQ) held a Public Meeting on Monday June 9th, that was attended by over 130 residents in opposition to the project. DEQ’s report is in favor of the plan. The deadline for public comment was June 24th. SDCC has submitted a box of documents and opposition letters in hopes to persuade the Water Control Board (WCB) to vote against this project at their July 28th meeting. The WCB is scheduled to meet on July 28th in Richmond and vote on this project.

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – Many Ocean Park residents have been involved in identifying the problems with this project. Due to their diligence, it appears that the LBR has been moved down on the list of possible sites. Council is pursuing possible land purchases as an alternative. Also, as a testament to the opposition’s concerns, a barge recently ran into the Lesner Bridge justifying the community’s opinion that the project would create too large a risk.

Proposed Rezoning of City Marina - Planning Commission review is scheduled for July 9th at noon in City Council Chambers. SDCC plans to take a vote at our June 30th general meeting, so please come prepared to discuss and vote. Visit the website for latest proffers and restrictions. Phase IV Shore Drive Demonstration Project – A citizen information meeting was held on Thursday May 22nd regarding the planned improvements to Shore Drive between Marlin Bay and East Stratford Rd in the Ocean Park area. Several street closures and median cut fill-ins are planned for this area. Attendance was small to the public meeting, so Ocean Park may want to get information directly to its effected residents. SDCC has asked for electronic versions of the presentation and will forward as soon as they are received.

Action Plans for PHP – Discuss and vote on any actions or position statements. Email campaign, Should we send emails to the WCB before the July 28th meeting? Should we call them beforehand? Discuss how we want to best use our legal counsel for the Richmond meeting. Who needs to go to the Richmond meeting, should be rent a bus?

City Council Candidate Forum and Questionnaire – Where should a forum be held? When should it be held? Who should be the moderator? What type of format should it follow? Be prepared to discuss these questions and volunteer for the forum committee. Also be thinking of questions for a candidate questionnaire.

SDCC General Meeting Agenda - Monday May 19, 2008

SDCC General Meeting - Monday May 19, 2008,  7:30 to 9:00pm
Ocean Park Volunteer Rescue Squad Hall (parking in back, on side streets and across Shore Drive)
There are no planned programs for this month.  This time will be deferred to the Old/New business due to the many
important issues and concerns that need to be addressed.
The general agenda for the evening will be:

Old Business- 
Indigo Dunes Project
- Department of Environmental Quality (DEQ) has issued a Preliminary Permit and will be
holding a public hearing at their office 5636 Southern Blvd on Monday June 9th.  The formal hearing starts at 7:30pm,
but the informal part starts at 6:30pm.  The informal part will include a presentation by me on the draft permit, a possible
presentation by the applicant (if they choose to do so), and Q&A. The comment period continues until June 24th and
written comments will be accepted until then.

Lynnhaven River Proposed Spoils Transfer Station – SDCC has sent a letter of opposition to the LBR site and a
letter requesting Council to make an official vote on any site that is picked No response has been received.  Only 3
sites are being considered, Saw Pen Point, Thalia Elementary and LBR.  City Staff plans to present City Council their
recommendation on Friday May 23rd , it’s unknown if this briefing is open to the public.  If the LBR site is chosen, the
VMRC plans to hold a public hearing on Tuesday July 22nd.  Residents will be asked to send emails and make phone
calls to Council members letting them know that LBR is the wrong site.

Cape Henry Beach Sand Replenishment – City Council and the City’s Attorney’s Office have issued letters to 6
groups stating their claim to public easement and plans to move ahead with paperwork to make Cape Henry Beach the
spoils site for the next dredge cycle in 2009/2010.

Proposed Rezoning of City Marina - Planning Commission review hearing was deferred.  A new review date has not
been set.  It was deferred to provide more detail on proffers/restrictions for the request to rezone the marina to B-1. 
SDCC will be taking an official position vote on this at our June 30th meeting.  SDCC reps need to discuss this with their
organizations before then.  Visit the website for latest proffers and restrictions.  Remember, the current arrangement is a
money making venture for the City, about $50,000 per year.  Making it a private venture runs the risk of losing this
income.

SDCC Oyster Roast – Mark your calendars for Saturday Nov 15th from noon until 4pm at the VB Resort Conference
Hotel.  Committee meeting will begin in June/July.  Email Todd if you’re interested in helping.  Todd@sdcc.info

Shore Drive Clean Up – Clean up held on May 10th was a success.  Thanks to those dozen volunteers who came out. 
Periodic clean ups have resulted in less trash being found each time.  Keep up the good work.  More volunteers are
always welcome. 

New Business - 
Action Plans for LBR
– Discuss and vote on any actions or position statements.  Since validation has been received
showing that the State did pay for a portion of the ramp, Joe Bouchard has been asked to weigh in on the LBR site, but
no response has been received to date.
Action Plans for PHP – Discuss and vote on any actions or position statements.  Email campaign, call list to get people
to the public hearing, etc.  Make sure your groups are filling in the call list blanks for those willing to attend meeting in a
show of support. 
Phase IV Shore Drive Demonstration Project – A citizen information meeting will be held on Thursday May 22nd from
5 to 7pm at Hermitage Elementary School regarding the planned improvements to Shore Drive between Marlin Bay and
East Stratford Rd in the Ocean Park area.
Clean the Bay Day – Clean the Bay day is June 7th.  Mark your calendars.

Pilot article about putting sand on beach east of Lesner

Sections of Cape Henry Beach, between First Landing State Park and the Lesner Bridge, have eroded and need the sand, officials said. In exchange for the sand, the city wants residents to sign over public use of the beach for recreation. Twelve of the 21 property owners and condominium associations within the two-mile stretch have agreed.

City’s Beach Management Plan, Cape Henry Beach, easements & negotiations to replenish the beach

To help settle the mounting debts of the Civil War, the commonwealth in 1868 sold off “the desert tract,” the elbow of land where the Chesapeake Bay meets the Atlantic Ocean. Didn’t know that did you?

Condo Associations, Civic Leagues, the City plus SDCC helping to moderate the discussions have been trying to work out an agreement to replenish the beaches on the east side of the Lesner Bridge.

Sand taken from dredging the Lynnhaven Inlet would be used. Ocean Park’s beaches were replenished using sand taken from the Lynnhaven Inlet. You may remember the dredge work that was done some months ago.

An update from the BSRTF

The BSRFT has been working hard on getting together a plan that will help get sand on the beaches, east of the Lesner Bridge.  Here’s a very, very short update.

The property owners that have made a “no easement” decision are:
