SDCC General Meeting November 24th 2008 Agenda

Program/Presentation –

1.  Oyster Restoration Project – Native or Non-native, which is best?  Mrs. Laurie Sorabella, Assistant Director and Marine Scientist for Lynnhaven River NOW, will discuss the current Army Corp study and explain why LRN, the Chesapeake Bay Foundation, Oyster Reef Keepers of Virginia, and all of the nearby Mid-Atlantic states are saying “no” to introducing Crassostrea ariakensis (Asian oyster) to the Cheapeake Bay.

2.  Pound pole fishing nets – Should more nets be allowed off the shores of Cape Henry Beaches?  Mr. Mark Swingle, Virginia Aquarium Director of Research and Conservation, will discuss pounds nets, their impact and the recent request to build 4 new nets off Cape Henry..

Old Business-
Indigo Dunes Project – There will be no State Water Control Board hearing in December.  A new hearing date has not been set, but the WCB has told us that a 30 day notice has to be given prior to any hearing.  So the next notification by the applicant would have to be no later than Dec. 6th for a Jan hearing.  SDCC is working with our attorney, Richard Whittemore and some college law students on position statements and possible appeal processes.

City Marina Rezoning – In accordance with the SDCC’s Sept motion, a letter was sent on Oct 27th to Barry Frankenfield requesting that the City withdraw the request for rezoning of the City Marina property.  The SDCC received an email in return stating the request had been withdrawn.  The SDCC has subsequently requested the Bayfront Advisory Committee (BAC) to take the lead on any future plans regarding this property and to ensure that all applicable parties are represented from the start of discussions.

Update on Lesner Bridge Replacement – Figg, the new bridge design consultant, has made a presentation to the BAC at their September meeting.  No contact has been made with the SDCC to go over updates or alignment plans.  Do we want a speaker to come to our January meeting?  Also, what is the groups opinion on the bridge width and possible alignment?

New Business –

Oyster Restoration Project – Should SDCC take a position on this subject?  If so, should we send a letter to the Army Corp of Engineers in support of LRN’s and CBF’s position or a letter supporting the introduction of non-native oysters?

Pound Pole Fishing Nets - Should SDCC take a position on this subject?  If so, should we send a letter to the Virginia Marine Resource Commission (VMRC) in opposition to these 4 specific permits or something broader that asks them to prohibit any new nets off the shores of Cape Henry & Chicks Beaches?  Also, what role should the BAC and the City play in this topic?

Bayfront Advisory Committee (BAC) Update – In an effort to get the BAC more involved in the community’s issues, the SDCC has been identifying concerns and asking the BAC for action.  To date, these are the issues that have been identified to BAC (City Marina Future, Pound Pole Net Licenses, Native vs. Non-native Oyster Restoration Project).  This is just a small number of our issues, the SDCC officers would like to have the group identify all of the additional issues so we can send them to the BAC for similar action.  Some suggestions are Create a future Lynnhaven River dredging plan that eliminates the boat ramp as a transfer site, Create a plan for the purchase or land swap deal to acquire Pleasure House Point (Indigo Dunes) from the Sandlers, Re-evaluate the currently funded 2 phases of the Shore Drive Improvements to reduce costs, Take a position on Sand Replenishment for Cape Henry Beach.

Crab Creek and Long Creek Dredging – According to Mr. Michael Kay, City Public Works, the City is planning to have Crab Creek dredged as well as providing some maintenance dredging to Long Creek in the coming months.  The specifications are under review and a survey of the Crab Creek and Long Creek channels and the associated material placement areas is underway.  It is anticipated that the project will be advertised for bid in late November to early December with award and Notice to Proceed in January.  The project will be packaged to allow either mechanical or hydraulic dredging; the contractors bidding the project will decide how they want to bid the project.  Historically mechanical means has been the preferred method by contractors.  In past contracts signs and notices were posted at the boat ramp as well as notification to the Coast Guard for issuance of a Notice to Mariners when the project is to begin and during construction, these procedures will be used again for this contract.

2009 SDCC Officer Election – The following people will be running for 2009 SDCC Office.  They are currently unopposed; however, the SDCC by-laws allow nominations to be made from the floor with the nominees consent.  All members are eligible to vote. SDCC General Meeting Agenda - Monday October 27, 2008

Program/Presentation – No planned presentation.  There is a good chance that a few candidates will be present and we will allow them a couple minutes each to impress us.

Old Business-
Indigo Dunes Project – Department of Environmental Quality (DEQ) completed their recommendation and submitted it along with responses to the public comets to the State Water Control Board (WCB) on Sept 30th.  The WCB hearing set for October 17th was deferred at the request of the applicant (the Sandlers).  A new hearing date has not been set, but the next WCB hearing will take place on Dec 3rd & 4th.  The applicant must notify the WCB no later than Nov. 5th if they want to be placed on the agenda.  SDCC is working with our attorney, Richard Whittemore and some college law students on position statements and possible appeal processes.

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – All Mayor and City Council candidates were opposed to using the LBR as a transfer station and supported having multiple sites in the areas where the dredging supports.  Lee Shuler FOIA’d the City and received a bridge impact study that says if a fully loaded barge traveling at 2 knots were to hit the bridge pillar, the pillar would fail.  Just imagine what would happen if it hits at the actual speeds we all know are there (5-6 knots).  The study was dated Oct 3rd, 2 days after the SDCC forum.  Is the City still pursuing the LBR as a possible site? 

City Council Candidate Forum– SDCC and OPCL held a Candidate Forum on Wednesday Oct 1st at Baylake United Methodist Church.  About 120 residents came to hear 14 of the 15 candidates answer 9 questions pertaining to the Shore Drive area.  If you attended, the SDCC would like to have you comment on the forum, good or bad, so we can capture ideas for the next one in 2 years.

SDCC Officer Nomination Committee – The nominating committee finalized the candidate list for 2009.  The following people will be running for 2009 SDCC Office.  They are currently unopposed, however, the SDCC by-laws allow nominations to be made from the floor with the nominees consent.  Elections will be held at the November SDCC General Meeting.  All members are eligible to vote.

New Business -

Update on Lesner Bridge Replacement – Figg, the new bridge design consultant, was in town performing interviews regarding bridge alignment.  Residents of 3556 were contacted and found out that current plans have the new bridge being placed to the north.  The bridge will come right next to 3556’s access road.  SDCC needs to discuss taking a formal position on the bridge width.  Should the bridge be built 8 lanes wide as currently planned or should it be reduced to 6 lanes wide?  (Both plans only have the road striped for 4 lanes).  Figg wants the 8 lanes so they can maintain 4 lanes of traffic during all phases of construction.  A 6 lane wide bridge would only allow 3 lanes during construction.

Bayfront Advisory Committee (BAC) Update – The BAC discussed plans to move ahead with neighborhood signage to be part of each demonstration project.  The signs will be minimal design and consistent.  Something that shows the theme of the live oak.  BAC is also deciding if the Shore Drive area should be included in the City strategic growth areas (SGA) in the 2008 Comprehensive Plan.  Being an SGA may bring more funding to the area, but may also designate us as an area that wants high density development.

Virginia Beach Neighborhood Conference – One key discussion held dealt with the intersection of Kendall and Shore Drive.  Traffic engineers were asked to look into lowering the speed limit from N. Great Neck to First Landing State Park.  They were also asked to look at a flashing light triggered by a car at the stop sign and/or pedestrian push buttons.

The City’s New Comprehensive Plan – Based on the BAC’s position, should SDCC take a position on our area relative to the Comp Plan?  Lynnhaven River NOW has also submitted a position paper.

Program/Presentation – Mr. Barry Frankenfield from the City’s Park and Rec department will be discussing the status of the proposed rezoning and privatization of the City Marina (next to Chick’s Oyster Bar).  This proposal has been set to go to the Planning Commission twice and deferred.  This property is a money making operation for the City and many of you have expressed opinions that you’d like to see it stay in the City’s possession.  Come hear the updates and participate in the Q&A session.

Old Business-
Indigo Dunes Project – Department of Environmental Quality (DEQ) has completed their recommendation and should be submitting it to the State Water Control Board (WCB) on Friday September 26th.  The WCB agenda has been issued and they will hear this permit in Richmond on October 16th between 9:30 and Noon.  SDCC is pursuing legal representation for the October WCB meeting.  SDCC contacted City Council asking that negotiations begin toward finding a way to sell or swap the land in an effort to preserve it as open space in accordance with the City’s Open Space Plan.  We were told that the City would not approach the Sandlers and that the Sandlers would have to approach them.

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – City Staff (Mr. Hansen) briefed City Council and recommended the site off VB Blvd as the primary transfer site.  City Council has agreed that this site is the preferred location and has authorized Staff to move forward.  Thanks to all the Guard Dogs for their efforts.

City Council Candidate Forum and Questionnaire – SDCC and OPCL will hold a Candidate Forum this Wednesday Oct 1st at Baylake United Methodist Church, 4300 Shore Drive, 7:00pm-9:30pm.  The candidates will be given 1 minute to answer questions.  The candidates will also have the option of providing written comments after the event which will be posted on the website.

New Business -

Update on Lesner Bridge Replacement – City Staff will be providing an update on the Lesner Bridge replacement design project at the next Bayfront Advisory Committee Meeting.  The next BAC is scheduled for October 16th at 3:30pm in the Bayside Rec Center.

Bayfront Advisory Committee (BAC) September Meeting Update – The BAC met Sept. 18th and discussed some of the following items.  No longer hold evening meeting.  Working on modifications to the Shore Drive Overlay District.  The quarterly newsletter will no longer be distributed by US Mail.  City plans to hold an Alternative Energy Town Hall meeting in November.

The City’s New Comprehensive Plan - This document advises everything that is decided in the City over the next five years.  The new Comprehensive Plan will be completed in early 2009.  Citizens’ suggestions, comments and thoughts about priorities are sought in the process of developing this plan for our city.  To facilitate this, the City will be hosting “open house” meetings where you will have an opportunity to express your ideas.  All of the meetings are 7:00-9:00 P.M. and three meetings are close to Shore Drive Corridor. All residents are asked to attend at least one and express your opinions for our area.

Due to a conflict in the SDCC officer’s schedules, there will be no general meeting this month.  The next SDCC general meeting will be September 29, 2008.

Issues and concerns update

Indigo Dunes Project – Department of Environmental Quality (DEQ) plans
to have a recommendation complete and submitted to the State Water
Control Board (WCB) by September 19th.  The WCB is scheduled to meet
in Richmond on October 16th and will review this project as part of
their meeting.  The SDCC Pleasure House Point (PHP) committee met with
the Chesapeake Bay Foundation (CBF) and our legal representation to
put together a plan for the WCB hearing.  SDCC is pursuing additional
legal representation for the October WCB meeting.  SDCC is also
putting together a letter to send to City Council asking that
negotiations begin toward finding a way to sell or swap the land in an
effort to preserve it as open space in accordance with the City’s Open
Space Plan.

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – City

(4338 VB Blvd.) just off VB Blvd as a possible transfer site.  This
site would also provide kayak & canoe access when not being used as a
transfer station.  City Staff is looking at purchasing or condemnation
of all the property in the area to also allow a Fire Station.  A Staff
briefing to City Council has been planned, but not held to date.

letter to City Staff and Council opposing the rezoning from P-1 to
B-2.  Reasons for opposition include the fact that a marina is
considered a principal use in a P-1 zoning district so there is no
need to rezone and the current arrangement is a money making venture
for the City, about $50,000 per year.  Making it a private venture
runs the risk of losing this income.  City staff, Barry Frankenfield,
will be attending the September SDCC General meeting to discuss this
issue.  Please come and express your specific concerns with the plan

Marina Shores Redevelopment Plans – Plans are moving forward to
redevelop the area into 5 and 7 story tall office buildings with
retail on the first floor.  The plan includes a parking structure
between the offices and the single family homes to the north.  The dry
storage facility will also increase in height by 2 stories and an
additional floating pier will be added parallel to Long Creek from the
marina all the way to Cape Henry Shores.  The plan will increase the
number of car trips by about 6,000 and require a stop light at the
intersection of North Great Neck Road and Lynnhaven Drive.

Cape Henry Beach Sand Replenishment – City Staff and City Council are
working toward resolving specific concerns from some of the
associations that are willing to provide construction easements but
not the public easements requested by the City.  Staff plans on
working through these issues to support the 2009/2010 dredging cycle.

City Council Candidate Forum and Questionnaire – SDCC agreed to
partner with OPCL and host a City Council Candidate Forum the end of
September or beginning of October.  Location have been narrowed to
the Baylake United Methodist Church.  Final plans are being
arranged, so stay tuned for an exact date, location and time.  Todd
will moderate and the format is still being decided.

SDCC Oyster Roast – Mark your calendars for Saturday Nov 15th from
noon until 4pm at the VB Resort Conference Hotel.  Volunteers are

Old Business-
Indigo Dunes Project – Department of Environmental Quality (DEQ) has asked for more time to review and answer the public’s concerns before going before the State Water Control Board (WCB).  The next WCB meeting is scheduled for September 30th.  The SDCC Pleasure House Point (PHP) committee has scheduled a meeting with the Chesapeake Bay Foundation (CBF), Lynnhaven River Now (LRN), Wetlands Watch and our legal representation to put together a plan for the WCB hearing. 

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – City Staff is still pursuing the purchase of land behind the AT&T-Battery Plus building on the Blvd. for the dredging of the Western Branch as a permanent dredge transfer station. This site would also provide kayak
& canoe access when not being used as a transfer station.  City Staff is looking at purchasing or condemnation of all the property in the area (excluding the vets office) to also allow a Fire Station.  Staff plans to present details to City Council on Aug 12 at a closed session.

SDCC Oyster Roast – Mark your calendars for Saturday Nov 15th from noon until 4pm at the VB Resort Conference Hotel.  First committee meeting is scheduled for Thursday August 21st at 6:30pm at Charlie’s Restaurant.  Volunteers are needed, email Todd if you’re interested in helping.  Todd@sdcc.info

SDCC Officer Nomination Committee – The nominating committee is narrowing down the list of candidates and is still in need of a good candidate for Vice President or Secretary.  If you are interested in running or know of anyone that may be, please contact Dan Creedon at DanVaB@aol.com.  The committee will make their presentation of names at the October 27th general meeting.

New Business -

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – Should SDCC write a letter to City Staff and Council supporting the plan to purchase and/or condemn businesses behind PEP Boys for a transfer station?  Should SDCC partner with Saw Pen Point C.L. is support of this site?

Community Legislative Town Hall Meeting -The City of Virginia Beach and the Virginia Beach Council of Civic Organizations will be co-hosting a town-hall style discussion to give citizens an opportunity to provide valuable input into the City’s 2008 Legislative Agenda – goals which the City will submit to members of the local General Assembly delegation later in the year.  Meeting will be Wednesday August 6th at 7:30pm in the VB Convention Center and is open to the public.
Indigo Dunes Project – With the possible Sandlers financial troubles reported by the Virginian-Pilot, does the SDCC think it’s a opportune time to sit down with City Staff and Council to discuss working up possible purchase scenarios (land swaps, tax reductions, etc.) and then have the City pursue these plans with the Sandlers?

Old Business-
Indigo Dunes Project
- Department of Environmental Quality (DEQ) has issued a Preliminary Permit and will be
holding a public hearing at their office 5636 Southern Blvd on Monday June 9th.  The formal hearing starts at 7:30pm,
but the informal part starts at 6:30pm.  The informal part will include a presentation by me on the draft permit, a possible
presentation by the applicant (if they choose to do so), and Q&A. The comment period continues until June 24th and
written comments will be accepted until then.

Lynnhaven River Proposed Spoils Transfer Station – SDCC has sent a letter of opposition to the LBR site and a
letter requesting Council to make an official vote on any site that is picked No response has been received.  Only 3
sites are being considered, Saw Pen Point, Thalia Elementary and LBR.  City Staff plans to present City Council their
recommendation on Friday May 23rd , it’s unknown if this briefing is open to the public.  If the LBR site is chosen, the
VMRC plans to hold a public hearing on Tuesday July 22nd.  Residents will be asked to send emails and make phone
calls to Council members letting them know that LBR is the wrong site.

Cape Henry Beach Sand Replenishment – City Council and the City’s Attorney’s Office have issued letters to 6
groups stating their claim to public easement and plans to move ahead with paperwork to make Cape Henry Beach the
spoils site for the next dredge cycle in 2009/2010.

Proposed Rezoning of City Marina - Planning Commission review hearing was deferred.  A new review date has not
been set.  It was deferred to provide more detail on proffers/restrictions for the request to rezone the marina to B-1. 
SDCC will be taking an official position vote on this at our June 30th meeting.  SDCC reps need to discuss this with their

money making venture for the City, about $50,000 per year.  Making it a private venture runs the risk of losing this
income.

SDCC Oyster Roast – Mark your calendars for Saturday Nov 15th from noon until 4pm at the VB Resort Conference

Shore Drive Clean Up – Clean up held on May 10th was a success.  Thanks to those dozen volunteers who came out. 
Periodic clean ups have resulted in less trash being found each time.  Keep up the good work.  More volunteers are
always welcome.

Action Plans for LBR
– Discuss and vote on any actions or position statements.  Since validation has been received

Presentation on proposed parking deck at Westminster-Canterbury(WC) – Mr. Bill Pine from WC will discuss the
proposed plan to build a 3 story parking deck where the current ground parking exists.  This deck will add about 150
spaces and will be shielded from view by existing trees.  Bill will show several architectural sketches and hold a
question and answer session after the presentation.

Old Business-

Indigo Dunes Project – Department of Environmental Quality (DEQ) will be issuing a Preliminary Permit.  The SDCC
will be submitting a letter to DEQ identifying the opposition points to the 2nd proposed plan.  These opposition points are
identical to the ones made for the plan that is going to Circuit Court since very little was changed and nothing to reduce
the community’s concerns.

Lynnhaven River Proposed Spoils Transfer Station – According to Councilman DeSteph, 2 new sites on the
Western Branch are being evaluated.  The SDCC has set up an area on http://www.sdcc.info where residents can submit
their suggestions for additional sites.  Residents are highly encouraged to add sites to the list. 
We’ll also chat about questions being submitted to P/W about the permanent facility & how it will impact the Shore Drive
Community. Current plan is to ask questions, get responses to make public, have each SDCC member vote on supporting or
opposing the transfer station as presented.

Cape Henry Beach Sand Replenishment – City Council and the City’s Attorney’s Office will be moving ahead with
necessary plans and paperwork to make Cape Henry Beach the spoils site for the next dredge cycle in 2009/2010. 
Nice job to all of those groups and members that worked on making this happen. 

SDCC Oyster Roast – Paperwork has been received for Saturday Nov 15th from noon until 4pm at the VB Resort
Conference Hotel.  Suggestion to have Eddie Sal as entertainment and to also invite the Cox H.S. artists for a art show. 
Are there any other suggestions?  We also need a chair or co-chair for the event.  If you like to throw a party, this
position would be perfect for you, who will step forward?

New Business -

SDCC Membership and Committee Participation – SDCC Membership forms have been mailed out.  Our goal is to
have 35 paid members this year.  This year’s packets contained a information form which we’d really like each group to
take the time and fill out.  Much of the information requested will help SDCC become a better organization.  Have you
received yours and have you responded?

2nd Annual Shore Drive Town Hall Meeting – Last month’s meeting it appeared everyone wanted to hold a Town Hall
meeting.  Now we just need to solidify a date, time, location and topics.  Suggestion was to hold it in May or June at the
same place as last time.  SDCC officers will check the hall availability and we will decide on one. 
SDCC Officer Nomination Committee – The nominating committee is getting an early start for the upcoming election
of 2008/9 officers.  If you are interested in running or know of anyone that may be, please contact Dan Creedon at
DanVaB@aol.com.  The committee will make their presentation of names at the October 27th general meeting.

Proposed Rezoning of City Marina - City Planning is scheduled to go before the Planning Commission to request the
rezoning of the marina to B-1 with proffers.  Several concerns were discussed at our last meeting and emails have been
exchanged with the City since them addressing these concerns.  Now the SDCC has to decide if we want to take a
position on this issue and what that position will be.  Come prepared to discuss.  If a position is warranted, then it will be
made either at the planning commission meeting or most likely at the City Council meeting that will follow.

Presentation on City Marina Rezoning and Privatization Plan – Faith Christie, City Planner, or designated rep. will be present to
answer questions on the new proposal for the City Marina. The request is being changed to a Conditional Rezoning. New signs will be posted shortly. The new plan contains proffers and planned to be heard the at the May 14th Planning Commission meeting. City Council hearing will be in late May or early June 2008. SDCC would like a small committee to work with the City and plan the future of this site. Representatives from Lynnhaven Colony, SDCC, Vista Circle, Boat Slip owners, BAC and City Staff are asked to participate. Proffers for this site are proposed to limit the uses of the Lynnhaven Marina Property. The only uses that shall be permitted in the requested B-2 Zoning Area are listed below.
• Commercial Marina including fuel service, subject to obtaining a conditional use permit (City operation would not require a
Conditional Use Permit)
• Off-site parking (use of parking for off-site uses not directly related to the Marina slip requirements)
• Outdoor Plaza (allows for an open area with paving, planting, and lights, benches and picnic tables also could be permitted for
casual seating and eating sandwiches and snacks purchased in the specialty shop)
• Specialty Shops/retail store of specialty goods, not to exceed 3,000 sq. ft.
• No structure on the site shall exceed thirty (30) feet in height.
Proffers NOT included: The suggested revised proffers do NOT include: Commercial Recreational Facility; Commercial Parking lot, Outdoor Café, and Personal Watercraft.

Indigo Dunes Project – Continued discussion on Botanical Garden proposal from last meeting. An SDCC vote is recommended at this meeting, so be prepared to vote your community’s view. Continued investigation by PHP committee on the possibility of a land swap with commercial property at Corporate Landing. Anyone interested in helping research and put together a proposal to submit to the City is asked to contact Todd Solomon at todd@sdcc.info. SDCC also plans on making this topic a major campaign issue for the Nov. City Council elections.

Lynnhaven River Proposed Spoils Transfer Station - Over 250 residents attended the March 19th public hearing Bayside Middle School. SDCC plans to gather ideas for alternate transfer sites for the Western and Eastern dredgings and has set up an area on http://www.sdcc.info where residents can submit their suggestions.

Cape Henry Beach Sand Replenishment - SDCC has sent a letter to City Council requesting they move ahead with a plan to implement the Cape Henry Beach Sand Replenishment resolution beginning with the next dredge cycle in 2009/2010.

R5R Proposed Code Amendments – Wed. March 12th, the Planning Commission voted (11-0) in favor of a modified proposed amendment change. The approved version limits the size of garages to 15% of lot size up to 1000 sq ft max and has some voluntary incentives changes to R5R lots. Lot sizes 6,500 sq ft. and smaller will have a reduced garage space and lots greater than 6,500 will be able to build the same as before. City Council will NOT be hearing this at the April 8th City Council session. Instead, City Council will appoint another committee to study the issue and try to find a solution that is supported by a greater majority than the modified amendment approved by the Planning Commission.

New Business -

It was also determined to hold the forum as the October General Meeting. Should the forum be kept small or should it be moved to a larger location? Presentation/Discussion on proposed botanical garden use for Pleasure House Point. A local resident has put together a proposed plan that shows a botanical garden, open-air stage and various other natural amenities on the PHP site.  The plan will be shown to members at this meeting.  SDCC would like to endorse this plan and present it to the Citys Open Space Sub-committee for action.  The Sub-committee has stated that they cannot recommend acquisition of this property to Council without a submitted usage plan.  Were not sure why this is the case, but we want to eliminate any excuses not to pursue acquisition of the property.

Marina Shores Marina Planned Development - 5 & 7 story commercial proposal was being shown at the recent VB Convention Center Boat Show.  The plan did not include a floating pier between the marina and Cape Henry Shores.  SDCC is still waiting to hear back from the developers attorney on a possible presentation date for one of our general meetings.

Lynnhaven River Proposed Spoils Transfer Station - Over 1000 signatures in opposition have been gathered.  Community reps spoke in opposition at the City Council Open Mike on Feb 5th.  SDCC submitted a letter of opposition to City Council and VMRC.  Councilman DeSteph requested Staff provide a formal briefing in front of the public.  The public hearing has been set for Wednesday March 19, 2008 at 6:30pm in Bayside Middle School.  Member groups are asked to have their residents send emails to City Council members expressing concern over the proposed permanent site.

City Marina Rezoning and Privatization Plan - Original 3 bids were officially rejected by City Council. SDCC has asked that a small team be created to allow public input to be gathered prior to the BZA hearing on the rezoning of the marina from P-1 to B-2.  SDCC is waiting on City Staff to set up the first team meeting.

Cape Henry Beach Sand Replenishment - SDCC reps contacted a few of the remaining groups that havent agreed to sign public easements.  No additional easements have been granted.  SDCC has sent a letter to City Council requesting they move ahead with a plan to implement the Cape Henry Beach Sand Replenishment resolution beginning with the next dredge cycle in 2009/2010.

New Business -
R5R Proposed Code Amendments On Wed. Mr. Peter Doherty, an expert in the field of ornithology (birds), will be the guest speaker at the SDCC general meeting. Mr. Doherty will be explaining his recent field ornithology activities in our area.  He has been working for BioDiversity Research Institute, capturing, banding and bleeding marsh birds, including rail, snipe, sparrows, warblers and wrens, as part of a federal court order arising out of past mercury discharges in the lower Penobscot River and upper Penobscot Bay.

The new JPA has been reviewed by DEQ.  DEQ has sent a response letter, which can be seen on the No Indigo Dunes website at this link.  The City still has all intentions to follow through with their appeal of the VMRC ruling.  A Circuit court date has not been set for this appeal.  SDCC is asking that each member organization pledge $500 or $1000. If all member groups pledge $500, this would allow SDCC to request payments in $100 increments for attorney fee as they are spent. Any remaining pledge amounts not needed would stay with the member organizations. Please ask your boards/membership to confirm a pledge no later than March 2008. SDCC will be asking for pledge amounts to be documented as part of the membership forms.

Mr. Barry Frankenfield of the City’s Park and Recreation department will be the guest speaker at the SDCC general meeting. Mr. Frankenfield will be explaining the plan to have a private company operate the City marina near Chick’s Oyster Bar & Vista Circle. Mr. Frankenfield will discuss the reason for this plan, any cost benefits, how it relates to the Shore Drive ULI study regarding Fisherman’s Walk and how the plan may impact the adjacent neighborhoods.

SDCC General Meeting, Monday, October 29th 2007 at 7:30pm at OPVRS

This month’s presentation will be on the Virginia Pilot’s Joy Fund.  Ms. Linda C. Hollingsworth will give a brief presentation and explain how the Joy Fund and SDCC can potentially work together.  She will have a question and answer session after the presentation.

Note: There will be no update on the proposed Marina Shores development this month.  Mr. R.J. Nutter informed me that the developer will not be ready to present until January 2008 at the earliest.  The current plan is to build 5 and 7 story office and restaurant spaces instead of 232 condos.  A copy of the proposed plan will be present for viewing.

Indigo Dunes Project Art Sandler has been in contact with the OPCL President.  He offered to meet with the OPCL Board and provide updates to the project.  The SDCC has in turn contacted Mr. Nutter and requested any presentation be made at an SDCC general meeting in lieu of smaller board meetings.  We are currently waiting for a response.  SDCC special projects account has been established to handle donations.  SDCC contacted the Virginia Beach Foundation to see if we can use them as a tax deductible clearing house.  The Foundation stated that using funds to support attorneys fees or pay for open space would not be considered a charitable cause for the Foundation.  SDCC is asking that each member organization pledge $500 or $1000.  This would allow payment requests to be issued in $100 increments for attorney retainers.  Please ask your boards/membership to pledge an amount.

232 apartments are being planned for Marina Shores Marina.  Design has changed from 232 condos to two office & restaurant buildings.  Buildings will be 5 and 7 stories tall.  A 5 story tall parking garage is also planned adjacent to Long Creek Cove residents.  Developer is willing to attend SDCC January meeting to give a presentation. 

Cape Henry Beach Sand Replenishment Task Force SDCC met with City Attorney Les Lilley on Oct. 17th.  City is meeting with associations that are reviewing proposed easement agreements.  Plans our to finish up meeting and move ahead by Dec 1, 2007 to support 2008/2009 dredge cycle.

Lesner Bridge Design Forum - Bridge Design Charette scheduled for Wednesday Nov. 7th from 8:30am to 4:30pm at VB Convention Center.  Contact Deborah Kravchak at dkravchak@clarknexen.com for available seating.

RFQ of City Owned Marina next to Chick’s - Private ownership will require rezoning from P-1 to B-4.  Is this a good thing?  Or will it be possible to build condo on the property after rezoning?

Update on Resort Conference Hotel CUP - Proposed expansion going before City Council.  Also requesting approval for outdoor activities (beach chair rental, kayak rental, jet ski rentals.

New Business

Vision Planning for Pleasure House Point - Should SDCC create a committee to create a vision for pleasure house point?  The committee would consist of the President and SDCC rep from each member organization.  Topics would include expanding on proposed funding method for purchase of property, what type of development would be acceptable to community, no build solution, research facility, etc.

No Indigo Dunes Oyster Roast - A fund raiser is being planned for Monday November 5th from 6 to 9pm at the Green Parrot in Chesapeake Beach.  Cost will be $20 advance and $25 at the door for all you can each shrimp.  Happy hour drinks all night.  Tickets can be purchased from Liz Dyer 425-2123 or manager at GP 460-4640.  The SDCC’s job will be to spread the word, attend and have a good time.  Watch the website http://www.noindigodunes.com ,your email and street signs for more information.

SDCC has hired Mr. Richard Whittemore as our legal counsel and he has
already been in contact with the City’s attorneys.  SDCC special projects
account set up to handle donations.  SDCC in contact with the Virginia Beach
Foundation to see if we can use them as a tax deductible clearing house.
$7,500 (OPCL, SDCC and Chesapeake Beach) in pledges committed so far.
$2,500 in review by Cape Story.  More will be needed, please ask your
boards/membership to pledge an amount.

232 apartments are being planned for Marina Shores Marina.  Project may
be heard by the Planning Commission in January (early next year).  The
Developer would be willing to attend our Oct meeting to give a presentation
on the 232 unit design.

Cape Henry Beach Sand Replenishment Task Force SDCC will be moving
forward with a meeting of the Task Force in early October.  Based on this
meeting, things should start moving forward to having sand from the next
Lynnhaven inlet dredge.  I have heard that several of the groups that were
contacted recently have agreed on easements.

Lesner Bridge Design Forum - Still no word on a new date being set.  If

Speakers for next month’s meeting - 1) Joy Fund representative & 2)
R.J. Nutter regarding Marina Shores project.  Are 2 speakers agreeable to

No Indigo Dunes Oyster Roast - An oyster roast fund raiser is being
planned for Sunday October 14th at Virginia Beach Seafood.  Cost is probably
going to be $20 with the profits going toward the legal fee fund.  Our job
will be to spread the word, attend and have a good time.  Watch the website

VBCCO Community Connections Event. - Saturday October 6th from 9:00am to
12:00pm, VBCCO will hold it’s annual information sharing event at the VB
convention center.  The guest speaker this year is Stewart Schwartz, Exec
Director of the Coalition for Smarter Growth in D.C.  He will discuss ways
that our communities can request smarter growth opportunities from our city
and developers.  This is one that every Shore Drive resident should attend.
You can also meet and gather information from city representatives.  There
will also be 3 round table discussions covering the following topics (Gangs
and Community Safety, Community Planning, Neighborhood Preservation/Code
Enforcement).

Last month’s open floor discussion was postponed and moved to this month.  No speakers have been scheduled, so if you know someone interesting that wishes to address the SDCC on a Shore Drive topic, please feel free to invite them.  Otherwise, we will use the time for open floor discussion.

Old Business-

Indigo Dunes Project City Council has directed the Legal staff to appeal the VMRC decision to the Circuit Court of Virginia Beach.  The City will send a letter of appeal by August 29th and will file additional required paperwork by the end of September.  The actual court hearing may take place around March of 2008 based on the backlog of court cases.  SDCC reps have been in discussion with several attorneys to determine what actions we should take next.  Here is a brief summary of what was suggested.

1. The SDCC or individual’s “Right of Standing” doesn’t look very strong.  At least 17 comparable cases (some VMRC, some general) were all dismissed based on lack of standing.  The current Virginia Law is very gray on this issue and that weighs heavily against us.  SDCC reps have concluded that it would not be the best use of our time and money to pursue a parallel appeal of the VMRC decision.
2. A couple of the attorney’s suggested that the SDCC could file an “Amicus Brief”.  This is a document that an attorney helps put together and submits to the court for possible review as part of the case (see definition below).  This brief cannot submit new information, but would provide all the important details that the SDCC would want to make sure aren’t missed by the City. ($$-research & brief)
3. The SDCC request State Legislators change the current laws to eliminate the gray areas and allow civic groups or individuals to appeal VMRC overturn decisions that were approved by wetlands boards.  The SDCC would solicit the aid of environmental groups like CBF, Wetlands Watch and Lynnhaven River Now to help create this change and lobby legislators.  The SDCC attorney could also help with drafting a proposed change to the law to get things going.  This could also be a big campaign issue to push on the state candidates. ($-research & proposed change to laws)
4. SDCC should continue to work with its experts and environmental groups to prepare for the Chesapeake Bay Preservation Board hearing.  Research on storm water is a must (existing conditions and credibility of proposed clean-up systems).  CBF is working in parallel and will have an expert present to speak at the hearing.  SDCC will also plan to read a presentation at the hearing similar to what was done at the wetlands board.
5. One local attorney also has some experience in property laws and would be willing to research and provide us with legal presentations for the Planning Commission and City Council hearings if this project makes it that far.  He would also be willing to put together an “Amicus Brief” for any circuit court case that may take place regarding land use issues. ($$-research, presentations, brief).
6. SDCC has sent out an email asking Shore Drive groups to make an initial pledge to support a legal fund.  Ocean Park - $2,500, Chesapeake Beach - $2,500, SDCC - needs to vote on a $2,500 pledge, Cape Story - needs to vote on a $2,500 pledge.
7. The SDCC will also pursue creating a 501(c)(3) tax deductible foundation so individuals can contribute.  A volunteer or 2 are needed to chair this action.  The purpose of this foundation will have to be determined as well as who sits on its board, what it’s charter, who will approve its creation, etc.  Set too narrow and our hands may be tied after Indigo Dunes is decided.  Set too broad and we may not be able to spend money for specific smaller actions.  Part of this foundation will also have to address fund raising.  Hiring a fund raising expert to be financed by this foundation should be a priority and needs to be an additional consideration.

232 apartments are being planned for Marina Shores Marina.  Proposal was approved by 9-2 by the Ches Bay Board on June 25th.  Nothing scheduled on the September 12th Planning Commission hearing.  The new plans have several structures that will be 8 to 9 stories.  That is about 110 feet tall or double the height of the current boat storage unit.  The SDCC will contact the developer and ask for a presentation at our September 24th meeting. 

Cape Henry Beach Sand Replenishment Task Force City sent letters out to several condos that haven’t agreed to sign public beach easements.  SDCC task force will schedule a meeting with the City by the end of September.  Final actions on how to move forward will be the goal of this meeting.

Boat ramp spoils site transfer location Ocean Park Board of Directors voted to oppose this project.  City staff will be presenting the project at the Ocean Park general meeting scheduled for September 6 at 7:00pm in the Ocean Park Volunteer Rescue Squad.  The spoils site has been proposed as a transfer station for dredging the Lynnhaven River.  40 to 50 dump truck per day for 6 months will take material across the Lesner Bridge and down Great Neck road.  Alternate ideas and locations will be discussed at this meeting.  Based on Staff’s responses to these suggestions, the SDCC may be able to take an overall position.
Two projects being heard at Planning Commission on August 8th. - 1)The Resort Conference Hotel was deferred to September 12th and 2) CUP for a 12 unit condo at 3228 Page Ave next to Lynnhaven Dunes was approved by the Planning Commission and goes before the City Council on September 11th.

New Business

SDCC vote on retaining a lawyer for Indigo Dunes issues Should SDCC retain a local lawyer to work on items 2, 3 and 5 above?  Need to vote on this issue to get thing moving in support of the City’s appeal.

SDCC vote on pledging $2,500 for legal fees. - A vote needs to be taken to set aside $2,500 for legal fees.

Should the SDCC pursue creating a 501(c)(3) foundation? - Should be create a foundation and if yes, what should be the foundation’s mission?  As a minimum, a vote should be taken on creating a committee to pursue establishing a foundation.  A committee chair needs to be also be determined.
Town hall meeting and/or State Candidate Forum. - Should the SDCC sponsor another Town hall meeting before the end of the year?  If so, what new information would be presented from the first one?  Should SDCC sponsor a Candidate Forum for Delegate Wardrups seat?  What do the groups East of the Lesner Bridge think about this?
Construction fences going up around Sandler property. - What does Sandler have the legal right to do now?  Does he have to obtain a permit to cut down all the trees or add fill to area outside the RPA?  How can we prevent him from filling in the wetlands until a final decision is made at CBPB?  The City needs to be the enforcement.  We need to get a contact and provide them with pertinent updates.

For those of us that aren’t lawyers:

Amicus curiae (plural amici curiae) is a legal Latin phrase, literally translated as “friend of the court”, that refers to someone, not a party to a case, who volunteers to offer information on a point of law or some other aspect of the case to assist the court in deciding a matter before it. The information may be a legal opinion in the form of a brief - testimony that has not been solicited by any of the parties - or a learned treatise on a matter that bears on the case. The decision whether to admit the information lies with the discretion of the court.

The situation most often noted in the press is when an advocacy group files a brief in a case before an appellate court to which it is not a litigant. Appellate cases are normally limited to the factual record and arguments coming from the lower court case under appeal; attorneys focus on the facts and arguments most favorable to their clients. Where a case may have broader implications, amicus curiae briefs are a way to introduce those concerns, so that the possibly broad legal effects of court decisions will not depend solely on the parties directly involved in the case.
