Program/Presentation – Staci Martin, District Program Specialist for Virginia State Parks headquartered out of First Landing.  She manages visitor experience—visitor experience is education programs, signage, information kiosks, public relations—anything that would enhance someone’s experience at the parks.  She’s been with the parks for five years.  She will be giving us some special inside information about what a treasure we have in First Landing State Park (known to long-time residents as Seashore State Park.)

Indigo Dunes Project – PHP committee has met once to create a plan for possible acquisition of the property.  Rumor has it that the bank has taken over ownership of the property.

Pound Pole Fishing Nets – US Coast Guard 25 foot boat ran into the new net and was damaged.  Friday July 10 at 2:30pm is the first appeal hearing at circuit court.  Please come and show support for the removal of these nets.

Cape Henry Beach Replenishment - Army Corps of Engineers is putting the project out for bids next month and expects to start dredging by the end of August, and also the City is pursuing, and expects to get, a legal “emergency” permit to include the four remaining holdouts when the sand is placed

Shore Drive Safety – Safety Committee meeting was held today to evaluate and implement various safety initiatives.  One of the safety items being discussed is the lowering of the speed limit from 45 to 35 mph from North Great Neck Rd to the First Landing State Park entrance (note, the lower speed limit is NOT for all of Shore Drive).  This would be done on a 6 month trail basis with a speed study and public input afterwards to determine if it becomes permanent.  Updates will be posted at http://www.sdcc.info
 
New Business

Lynnhaven River Restoration Plan – US Army Corps of Engineers will be holding the final presentation of a preliminary study to improve the Lynnhaven watershed on Wed. July 1st at 7:00pm at the Bayside Rec. Center.  The meeting is open to the public and all are encouraged to attend.
Upcoming Events
Share Shore Drive Day – Sat. July 11, 2009.  7:30am start at Kokoamos.  Bicycle ride on Shore Drive to bring awareness to safety issues.
SDCC meeting - Monday July 27, 2009.  Strategic Growth Areas (SGA).  Is it right for Shore Drive?  Come find out from the City’s Planning staff which areas on Shore Drive have been designated as possible high density development areas.

Delegate Bouchard speaking at SDCC’s March meeting

Delegate Joe Bouchard will be speaking at the March 30, 2009, SDCC meeting.  He will have a special emphasis on environmental issues, but will also address other issues of interest to Shore Drive residents.  As a delegate, he currently serves on the House Science and Technology Committee; the Agriculture, Chesapeake, and Natural Resources Committee; the Governor’s Commission on Climate Change; and the Joint Committee on At-Risk Youth.

His efforts on behalf of Hampton Roads include promoting economic development through investment in research and development, high technology industries and the growing green economy, promoting robust growth in trade through the port, improving homeland security and emergency preparedness, and enhancing the effectiveness and efficiency of local governments, particularly their ability to cooperate regionally for the common good and to spend tax dollars more wisely.

Potluck dessert buffet Monday night at 6:45pm

In celebration of our volunteers and the completion of the 7 year tenure of our fearless leader, Todd, we invite you to join us Monday Nov.24 at 6:45pm at the rescue station (prior to our monthly meeting at 7:30pm) for a potluck dessert buffet.

Program/Presentation –

1.    Oyster Restoration Project – Native or Non-native, which is best?  Mrs. Laurie Sorabella, Assistant Director and Marine Scientist for Lynnhaven River NOW, will discuss the current Army Corp study and explain why LRN, the Chesapeake Bay Foundation, Oyster Reef Keepers of Virginia, and all of the nearby Mid-Atlantic states are saying “no” to introducing Crassostrea ariakensis (Asian oyster) to the Cheapeake Bay.

2.  Pound pole fishing nets – Should more nets be allowed off the shores of Cape Henry Beaches?  Mr. Mark Swingle, Virginia Aquarium Director of Research and Conservation, will discuss pounds nets, their impact and the recent request to build 4 new nets off Cape Henry..

Old Business-
Indigo Dunes Project – There will be no State Water Control Board hearing in December.  A new hearing date has not been set, but the WCB has told us that a 30 day notice has to be given prior to any hearing.  So the next notification by the applicant would have to be no later than Dec. 6th for a Jan hearing.  SDCC is working with our attorney, Richard Whittemore and some college law students on position statements and possible appeal processes.

City Marina Rezoning – In accordance with the SDCC’s Sept motion, a letter was sent on Oct 27th to Barry Frankenfield requesting that the City withdraw the request for rezoning of the City Marina property.  The SDCC received an email in return stating the request had been withdrawn.  The SDCC has subsequently requested the Bayfront Advisory Committee (BAC) to take the lead on any future plans regarding this property and to ensure that all applicable parties are represented from the start of discussions.

Update on Lesner Bridge Replacement – Figg, the new bridge design consultant, has made a presentation to the BAC at their September meeting.  No contact has been made with the SDCC to go over updates or alignment plans.  Do we want a speaker to come to our January meeting?  Also, what is the groups opinion on the bridge width and possible alignment?

New Business –

Oyster Restoration Project – Should SDCC take a position on this subject?  If so, should we send a letter to the Army Corp of Engineers in support of LRN’s and CBF’s position or a letter supporting the introduction of non-native oysters?

Pound Pole Fishing Nets - Should SDCC take a position on this subject?  If so, should we send a letter to the Virginia Marine Resource Commission (VMRC) in opposition to these 4 specific permits or something broader that asks them to prohibit any new nets off the shores of Cape Henry & Chicks Beaches?  Also, what role should the BAC and the City play in this topic?

Bayfront Advisory Committee (BAC) Update – In an effort to get the BAC more involved in the community’s issues, the SDCC has been identifying concerns and asking the BAC for action.  To date, these are the issues that have been identified to BAC (City Marina Future, Pound Pole Net Licenses, Native vs. Non-native Oyster Restoration Project).  This is just a small number of our issues, the SDCC officers would like to have the group identify all of the additional issues so we can send them to the BAC for similar action.  Some suggestions are Create a future Lynnhaven River dredging plan that eliminates the boat ramp as a transfer site, Create a plan for the purchase or land swap deal to acquire Pleasure House Point (Indigo Dunes) from the Sandlers, Re-evaluate the currently funded 2 phases of the Shore Drive Improvements to reduce costs, Take a position on Sand Replenishment for Cape Henry Beach.

Crab Creek and Long Creek Dredging – According to Mr. Michael Kay, City Public Works, the City is planning to have Crab Creek dredged as well as providing some maintenance dredging to Long Creek in the coming months.  The specifications are under review and a survey of the Crab Creek and Long Creek channels and the associated material placement areas is underway.  It is anticipated that the project will be advertised for bid in late November to early December with award and Notice to Proceed in January.  The project will be packaged to allow either mechanical or hydraulic dredging; the contractors bidding the project will decide how they want to bid the project.  Historically mechanical means has been the preferred method by contractors.  In past contracts signs and notices were posted at the boat ramp as well as notification to the Coast Guard for issuance of a Notice to Mariners when the project is to begin and during construction, these procedures will be used again for this contract.

2009 SDCC Officer Election –  The following people will be running for 2009 SDCC Office.  They are currently unopposed; however, the SDCC by-laws allow nominations to be made from the floor with the nominees consent.  All members are eligible to vote. SDCC General Meeting Agenda - Monday October 27, 2008

Program/Presentation – No planned presentation.  There is a good chance that a few candidates will be present and we will allow them a couple minutes each to impress us.

Old Business-
Indigo Dunes Project – Department of Environmental Quality (DEQ) completed their recommendation and submitted it along with responses to the public comets to the State Water Control Board (WCB) on Sept 30th.  The WCB hearing set for October 17th was deferred at the request of the applicant (the Sandlers).  A new hearing date has not been set, but the next WCB hearing will take place on Dec 3rd & 4th.  The applicant must notify the WCB no later than Nov. 5th if they want to be placed on the agenda.  SDCC is working with our attorney, Richard Whittemore and some college law students on position statements and possible appeal processes.

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – All Mayor and City Council candidates were opposed to using the LBR as a transfer station and supported having multiple sites in the areas where the dredging supports.  Lee Shuler FOIA’d the City and received a bridge impact study that says if a fully loaded barge traveling at 2 knots were to hit the bridge pillar, the pillar would fail.  Just imagine what would happen if it hits at the actual speeds we all know are there (5-6 knots).  The study was dated Oct 3rd, 2 days after the SDCC forum.  Is the City still pursuing the LBR as a possible site? 

City Council Candidate Forum– SDCC and OPCL held a Candidate Forum on Wednesday Oct 1st at Baylake United Methodist Church.  About 120 residents came to hear 14 of the 15 candidates answer 9 questions pertaining to the Shore Drive area.  If you attended, the SDCC would like to have you comment on the forum, good or bad, so we can capture ideas for the next one in 2 years.

SDCC Officer Nomination Committee – The nominating committee finalized the candidate list for 2009.  The following people will be running for 2009 SDCC Office.  They are currently unopposed, however, the SDCC by-laws allow nominations to be made from the floor with the nominees consent.  Elections will be held at the November SDCC General Meeting.  All members are eligible to vote.

New Business -

Update on Lesner Bridge Replacement – Figg, the new bridge design consultant, was in town performing interviews regarding bridge alignment.  Residents of 3556 were contacted and found out that current plans have the new bridge being placed to the north.  The bridge will come right next to 3556’s access road.  SDCC needs to discuss taking a formal position on the bridge width.  Should the bridge be built 8 lanes wide as currently planned or should it be reduced to 6 lanes wide?  (Both plans only have the road striped for 4 lanes).  Figg wants the 8 lanes so they can maintain 4 lanes of traffic during all phases of construction.  A 6 lane wide bridge would only allow 3 lanes during construction.

Bayfront Advisory Committee (BAC) Update – The BAC discussed plans to move ahead with neighborhood signage to be part of each demonstration project.  The signs will be minimal design and consistent.  Something that shows the theme of the live oak.  BAC is also deciding if the Shore Drive area should be included in the City strategic growth areas (SGA) in the 2008 Comprehensive Plan.  Being an SGA may bring more funding to the area, but may also designate us as an area that wants high density development.

Virginia Beach Neighborhood Conference – One key discussion held dealt with the intersection of Kendall and Shore Drive.  Traffic engineers were asked to look into lowering the speed limit from N. Great Neck to First Landing State Park.  They were also asked to look at a flashing light triggered by a car at the stop sign and/or pedestrian push buttons.

The City’s New Comprehensive Plan – Based on the BAC’s position, should SDCC take a position on our area relative to the Comp Plan?  Lynnhaven River NOW has also submitted a position paper.

SDCC General Meeting Agenda - Monday September 29, 2008

SDCC General Meeting - Monday September 29th, 7:30 to 9:00pm

Program/Presentation – Mr. Barry Frankenfield from the City’s Park and Rec department will be discussing the status of the proposed rezoning and privatization of the City Marina (next to Chick’s Oyster Bar).  This proposal has been set to go to the Planning Commission twice and deferred.  This property is a money making operation for the City and many of you have expressed opinions that you’d like to see it stay in the City’s possession.  Come hear the updates and participate in the Q&A session.

Old Business-
Indigo Dunes Project – Department of Environmental Quality (DEQ) has completed their recommendation and should be submitting it to the State Water Control Board (WCB) on Friday September 26th.  The WCB agenda has been issued and they will hear this permit in Richmond on October 16th between 9:30 and Noon.  SDCC is pursuing legal representation for the October WCB meeting.  SDCC contacted City Council asking that negotiations begin toward finding a way to sell or swap the land in an effort to preserve it as open space in accordance with the City’s Open Space Plan.  We were told that the City would not approach the Sandlers and that the Sandlers would have to approach them.

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – City Staff (Mr. Hansen) briefed City Council and recommended the site off VB Blvd as the primary transfer site.  City Council has agreed that this site is the preferred location and has authorized Staff to move forward.  Thanks to all the Guard Dogs for their efforts.

City Council Candidate Forum and Questionnaire – SDCC and OPCL will hold a Candidate Forum this Wednesday Oct 1st at Baylake United Methodist Church, 4300 Shore Drive, 7:00pm-9:30pm.  The candidates will be given 1 minute to answer questions.  The candidates will also have the option of providing written comments after the event which will be posted on the website.

SDCC Officer Nomination Committee – The nominating committee is finalizing the candidate list for 2009.  They will be presenting the list at October 27th general meeting and we will vote at our November meeting.  If you are interested in running or know of anyone that may be, please contact Dan Creedon at DanVaB@aol.com.

New Business -

Update on Lesner Bridge Replacement – City Staff will be providing an update on the Lesner Bridge replacement design project at the next Bayfront Advisory Committee Meeting.  The next BAC is scheduled for October 16th at 3:30pm in the Bayside Rec Center.

Bayfront Advisory Committee (BAC) September Meeting Update – The BAC met Sept. 18th and discussed some of the following items.  No longer hold evening meeting.  Working on modifications to the Shore Drive Overlay District.  The quarterly newsletter will no longer be distributed by US Mail.  City plans to hold an Alternative Energy Town Hall meeting in November.

The City’s New Comprehensive Plan - This document advises everything that is decided in the City over the next five years.  The new Comprehensive Plan will be completed in early 2009.  Citizens’ suggestions, comments and thoughts about priorities are sought in the process of developing this plan for our city.  To facilitate this, the City will be hosting “open house” meetings where you will have an opportunity to express your ideas.  All of the meetings are 7:00-9:00 P.M. and three meetings are close to Shore Drive Corridor. All residents are asked to attend at least one and express your opinions for our area.

Issues and concerns update


Indigo Dunes Project – Department of Environmental Quality (DEQ) plans
to have a recommendation complete and submitted to the State Water
Control Board (WCB) by September 19th.  The WCB is scheduled to meet
in Richmond on October 16th and will review this project as part of
their meeting.  The SDCC Pleasure House Point (PHP) committee met with
the Chesapeake Bay Foundation (CBF) and our legal representation to
put together a plan for the WCB hearing.  SDCC is pursuing additional
legal representation for the October WCB meeting.  SDCC is also
putting together a letter to send to City Council asking that
negotiations begin toward finding a way to sell or swap the land in an
effort to preserve it as open space in accordance with the City’s Open
Space Plan.

 

Lynnhaven Boat Ramp (LBR) Proposed Spoils Transfer Station – City
Staff is still pursuing the purchase of land behind the AT&T store
(4338 VB Blvd.) just off VB Blvd as a possible transfer site.  This
site would also provide kayak & canoe access when not being used as a
transfer station.  City Staff is looking at purchasing or condemnation
of all the property in the area to also allow a Fire Station.  A Staff
briefing to City Council has been planned, but not held to date.

 

Proposed Rezoning of City Marina - Planning Commission review has been
deferred indefinitely from the August 13th meeting.  SDCC has sent a
letter to City Staff and Council opposing the rezoning from P-1 to
B-2.  Reasons for opposition include the fact that a marina is
considered a principal use in a P-1 zoning district so there is no
need to rezone and the current arrangement is a money making venture
for the City, about $50,000 per year.  Making it a private venture
runs the risk of losing this income.  City staff, Barry Frankenfield,
will be attending the September SDCC General meeting to discuss this

Marina Shores Redevelopment Plans – Plans are moving forward to
redevelop the area into 5 and 7 story tall office buildings with
retail on the first floor.  The plan includes a parking structure
between the offices and the single family homes to the north.  The dry
storage facility will also increase in height by 2 stories and an
additional floating pier will be added parallel to Long Creek from the
marina all the way to Cape Henry Shores.  The plan will increase the
number of car trips by about 6,000 and require a stop light at the
intersection of North Great Neck Road and Lynnhaven Drive.

 

Cape Henry Beach Sand Replenishment – City Staff and City Council are
working toward resolving specific concerns from some of the
associations that are willing to provide construction easements but
not the public easements requested by the City.  Staff plans on
working through these issues to support the 2009/2010 dredging cycle.

 

City Council Candidate Forum and Questionnaire –  SDCC agreed to
partner with OPCL and host a City Council Candidate Forum the end of
September or beginning of October.  Location have been narrowed to
the Baylake United Methodist Church.  Final plans are being
arranged, so stay tuned for an exact date, location and time.  Todd
will moderate and the format is still being decided.

 

SDCC Oyster Roast – Mark your calendars for Saturday Nov 15th from
noon until 4pm at the VB Resort Conference Hotel.  Volunteers are

Old Business-
Indigo Dunes Project – Department of Environmental Quality (DEQ) has asked for more time to review and answer the public’s concerns before going before the State Water Control Board (WCB).  The next WCB meeting is scheduled for September 30th.  The SDCC Pleasure House Point (PHP) committee has scheduled a meeting with the Chesapeake Bay Foundation (CBF), Lynnhaven River Now (LRN), Wetlands Watch and our legal representation to put together a plan for the WCB hearing.

SDCC Oyster Roast – Mark your calendars for Saturday Nov 15th from noon until 4pm at the VB Resort Conference Hotel.  First committee meeting is scheduled for Thursday August 21st at 6:30pm at Charlie’s Restaurant.  Volunteers are needed, email Todd if you’re interested in helping.  Todd@sdcc.info

Community Legislative Town Hall Meeting -The City of Virginia Beach and the Virginia Beach Council of Civic Organizations will be co-hosting a town-hall style discussion to give citizens an opportunity to provide valuable input into the City’s 2008 Legislative Agenda – goals which the City will submit to members of the local General Assembly delegation later in the year.  Meeting will be Wednesday August 6th at 7:30pm in the VB Convention Center and is open to the public.
Indigo Dunes Project – With the possible Sandlers financial troubles reported by the Virginian-Pilot, does the SDCC think it’s a opportune time to sit down with City Staff and Council to discuss working up possible purchase scenarios (land swaps, tax reductions, etc.) and then have the City pursue these plans with the Sandlers?

Old Business- 
Indigo Dunes Project
- Department of Environmental Quality (DEQ) has issued a Preliminary Permit and will be
holding a public hearing at their office 5636 Southern Blvd on Monday June 9th.  The formal hearing starts at 7:30pm,
but the informal part starts at 6:30pm.  The informal part will include a presentation by me on the draft permit, a possible
presentation by the applicant (if they choose to do so), and Q&A. The comment period continues until June 24th and
written comments will be accepted until then.

Lynnhaven River Proposed Spoils Transfer Station – SDCC has sent a letter of opposition to the LBR site and a
letter requesting Council to make an official vote on any site that is picked No response has been received.  Only 3
sites are being considered, Saw Pen Point, Thalia Elementary and LBR.  City Staff plans to present City Council their
recommendation on Friday May 23rd , it’s unknown if this briefing is open to the public.  If the LBR site is chosen, the
VMRC plans to hold a public hearing on Tuesday July 22nd.  Residents will be asked to send emails and make phone
calls to Council members letting them know that LBR is the wrong site.

Cape Henry Beach Sand Replenishment – City Council and the City’s Attorney’s Office have issued letters to 6
groups stating their claim to public easement and plans to move ahead with paperwork to make Cape Henry Beach the
spoils site for the next dredge cycle in 2009/2010.

Proposed Rezoning of City Marina - Planning Commission review hearing was deferred.  A new review date has not
been set.  It was deferred to provide more detail on proffers/restrictions for the request to rezone the marina to B-1. 
SDCC will be taking an official position vote on this at our June 30th meeting.  SDCC reps need to discuss this with their
organizations before then.  Visit the website for latest proffers and restrictions.  Remember, the current arrangement is a
money making venture for the City, about $50,000 per year.  Making it a private venture runs the risk of losing this
income.

Shore Drive Clean Up – Clean up held on May 10th was a success.  Thanks to those dozen volunteers who came out. 
Periodic clean ups have resulted in less trash being found each time.  Keep up the good work.  More volunteers are
always welcome. 

New Business - 
Action Plans for LBR
– Discuss and vote on any actions or position statements.  Since validation has been received
showing that the State did pay for a portion of the ramp, Joe Bouchard has been asked to weigh in on the LBR site, but
no response has been received to date.
Action Plans for PHP – Discuss and vote on any actions or position statements.  Email campaign, call list to get people
to the public hearing, etc.  Make sure your groups are filling in the call list blanks for those willing to attend meeting in a
show of support. 
Phase IV Shore Drive Demonstration Project – A citizen information meeting will be held on Thursday May 22nd from
5 to 7pm at Hermitage Elementary School regarding the planned improvements to Shore Drive between Marlin Bay and
East Stratford Rd in the Ocean Park area.
Clean the Bay Day – Clean the Bay day is June 7th.  Mark your calendars.
